Terms of Service

These Terms of Service (“Terms”) govern your use of the Fearless Workplace website, tools, and services (collectively, the “Services”), operated by Vertical Edge Group LLC (“Company,” “we,” “us,” or “our”).

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Scope of Services

The Services include:

  • Educational content and digital tools

  • The Fearless Workplace Navigator and related frameworks

  • Coaching, consulting, and advisory services

  • Digital products, programs, and resources

The Services are designed to support workplace awareness, communication, and decision-making.

2. Important Disclaimer

The Services are for educational and informational purposes only.

They do not constitute:

  • Legal advice

  • Employment or HR compliance advice

  • Medical or mental health treatment

  • Therapy, diagnosis, or clinical services

Coaching services are not therapy.

Even if the Company or its representatives have backgrounds in counseling or related fields, those credentials are not being exercised in a clinical capacity through the Services.

You are responsible for your own decisions, actions, and outcomes.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding agreement to use the Services.

4. Accounts and Access

If you create an account or access paid Services:

  • You are responsible for maintaining the confidentiality of your credentials

  • You agree to provide accurate information

  • You are responsible for all activity under your account

We may suspend or terminate access for misuse.

5. Payments, Subscriptions, and Coaching Services

Payments

By making a purchase, you authorize us to charge your selected payment method.

All prices are subject to change at any time.

Subscriptions

If you enroll in a subscription:

  • You authorize recurring charges

  • Billing continues until canceled

  • Cancellation takes effect at the end of the current billing period

Coaching Services

For scheduled coaching sessions:

  • You are responsible for attending sessions at the agreed time

  • Rescheduling and cancellation policies will be communicated at the time of booking

Unless otherwise stated:

  • Sessions are non-refundable

  • Missed sessions may be forfeited

6. Refund Policy

Refund policies, if applicable, will be clearly stated at the point of purchase.

If no refund policy is stated, purchases are non-refundable.

7. User Content

You may submit or generate content through the Services, including messages, responses, or inputs (“User Content”).

You retain ownership of your content.

By using the Services, you grant the Company a limited license to use your content:

  • To operate and deliver the Services

  • To improve functionality and user experience

We do not guarantee storage or retention of User Content.

8. Intellectual Property

All materials provided by the Company are protected intellectual property.

This includes:

  • The Fearless Workplace Navigator

  • Behavioral frameworks and models

  • Training materials, scripts, and tools

You may not:

  • Copy, reproduce, or distribute materials.

  • Reverse engineer or extract frameworks.

  • Use the content to create competing products or services.

9. Prohibited Use

You agree not to:

  • Misuse the Services or attempt unauthorized access.

  • Interfere with system functionality or security.

  • Scrape, extract, or replicate content or tools.

  • Use the Services to develop competing offerings.

10. Third-Party Services

We may use third-party providers (e.g., payment processors, hosting platforms).

We are not responsible for their performance or practices.

11. Termination

We may suspend or terminate access at any time for violation of these Terms.

12. Disclaimer of Warranties

The Services are provided “as is” without warranties of any kind.

We do not guarantee:

  • Specific outcomes

  • Accuracy or completeness of content

  • Continuous or error-free operation

13. Limitation of Liability

To the fullest extent permitted by law:

The Company is not liable for:

  • Indirect, incidental, or consequential damages

  • Loss of income, employment, or business opportunities

  • Decisions made based on use of the Services

Total liability will not exceed:

  • The amount you paid for the Services, or

  • $100, whichever is greater

14. Indemnification

You agree to indemnify and hold harmless the Company from any claims arising from:

  • Your use of the Services

  • Your violation of these Terms

  • Your User Content

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms at any time. Continued use constitutes acceptance.
